

Quis custodiet ipsos custodes? The answer to that, at least in this case, would seem to be “Senate Republicans.”
On Wednesday, Senator Chuck Grassley (R-IA) took to his official X account with a startling announcement; an investigation by Senator Grassley has uncovered that anti-Trump prosecutor Jack Smith and his team, in the course of investigating President Trump for alleged mishandling of classified documents, did in fact carry out precisely the infraction for which they were investigating the president: Mishandling of classified documents, and the possible compromising of national security.

This isn’t the first time that Jack Smith and his team seem to have skated close to the edge, although this time, they may well have gone right through the ice.

Here are a few examples of possible infractions from the docs released, specifically, in the form of a letter from the Senate Judiciary Committee to Acting Attorney General Todd Blanche:
Messages involving personnel in Jack Smith’s Special Counsel Office (SCO) raise serious concerns about the Biden administration’s failure to properly secure classified materials. The messages show that these failures caused a security “violation and incident” where a Justice Department sensitive compartmented information facility (SCIF) accessible to SCO personnel was left open overnight and potentially longer.

While wearing Uncle Sam’s colors, I briefly served on a general staff and had a Top Secret clearance. I worked in a secure facility and routinely handled classified documents. If we had compromised our facility like that, the court martials would have been flying like starlings flocking in autumn.
There’s more:
For example, the messages show that there were concerns that 1) an individual was given access to classified materials without confirming they had the requisite “need to know”; 2) there was at least one instance where the potential movement of classified material accessed by SCO personnel housed in a Justice Department SCIF was unaccounted for, and 3) “a violation and incident” occurred when a SCIF accessible to SCO personnel was left open at least overnight and potentially longer. The messages appear related to Smith’s case against President Trump for allegedly mishandling classified materials, and I write to seek additional information in that regard.
Now, here’s the obvious question: What will the Justice Department do about this? The Senate can investigate, it can subpoena people and question them, but any charges will necessarily have to be filed by the Justice Department.
Here’s the thing: While more details are as yet forthcoming, these allegations look a lot like a combination of carelessness, incompetence, and callous disregard on the part of Jack Smith and his SCO team. And in the greatest irony of all, it all happened in the course of an investigation into President Trump over precisely the kind of infraction that Smith and his team may well have committed.
